Privacy Policy Theben AG

We, Theben AG (hereinafter "Theben"), are pleased that you have visited our website and are interested in our products and services. We take the protection of your privacy and the personal data you provide to us very seriously. It is a matter of course for us to observe the legal provisions on data protection. Below we inform you about what data we collect from you and for what purposes, how long we store it and what rights you have when we process your data.

In our data protection declaration, we use terms and definitions of the European Data Protection Regulation DS-GVO, especially Art. 4 DS-GVO. According to this regulation, we are the "controller" and you are the "data subject". Data relating directly or indirectly to you are "personal data". When we refer to your "data" in the remainder of this data protection declaration, this generally means the data that relates directly or indirectly to your person.

Fully automated processing of data when visiting our websites

When you visit our websites, our servers store a range of access data in an electronic log file as standard. This data includes the IP address from which you are accessing our website, the webpage you visited us from, the webpages you visit while on our site, the date and time that you accessed the pages, and therefore the duration of the visit. This data  is recorded in a fully automated manner and is only used to analyse errors and to make technical improvements to our web service. The recipients of this data are the Theben IT department and, if required, IT service providers engaged by Theben. The legal basis for the processing of this data is our legitimate interest to ensure that our websites continue to function correctly. The log file data is overwritten automatically after one week at the latest. Further fully automated data processing operations that take place when accessing our website relate to our use of cookies and our analysis of usage data when visiting our websites. These types of processing are described in separate sections of this data protection statement.

Newsletters

If you have expressly consented in accordance with Art. 6 (1) sentence 1 lit. a DSGVO, we will use your e-mail address to send you our newsletter on a regular basis. To receive the newsletter, it is sufficient to provide an email address.  We store your consent and the time of consent. Consent can be revoked at any time by unsubscribing from the newsletter. You will find a link to the unsubscribe page at the end of each newsletter.

Theben Media Pool

Registration

In accordance with the terms and conditions for the use of Theben Brand and Media Content, registration of the user is required for access thereto. In doing so, not only data of the legal entity "licensee" is collected and processed, but also of the natural person(s) who use the brand and media content on behalf of the licensee. Registration cannot take place without the provision of this data. Further personal data is voluntary. The personal data collected in the process will be processed solely for the purpose of implementing, monitoring and fulfilling the licence agreement. Neither your e-mail address (mandatory information) nor your address or telephone number (optional information) will be processed for purposes other than those stated.

Control of use

In accordance with the Terms of Use, the usage data of accesses to the Branded and Media Content are processed on a personal basis for the purpose of controlling the performance of the Licence Agreement.
Legal basis of the processing, your rights as a data subject

If you use the Media and Branded Content as an employee or agent of the Licensee, your personal data will be processed, on the one hand, in the legitimate interest of Theben AG to set up, grant, control and terminate the use for the Licensee and, on the other hand, in the legitimate interest of the Licensee as a third party under data protection law to set up, grant, control and terminate the use. The purpose of the processing is not directed at you as a natural person, but at the licensee as a legal entity. Your counter-interests may prevail, for example, if you are no longer working for the licensee.

Passing on data

In order to send you the access data for Theben Mediapool after registration, we will pass on your collected data to our service provider to create your personal access data. The service provider has been carefully selected and strictly bound to comply with data protection by means of an order processing contract.

Your rights

When using our Theben Mediapool, you have the rights listed under Data subject rights.

Storage period of usage data

The usage data will remain stored in a personalised form for as long as personalised control of the usage is necessary for the contractual partner Theben AG or the licensee.

Downloads of white papers or software / registrations

When you submit the form to download your copy of our white paper or your software, your information is collected and we use your information to create a personalised download link.  We do not use the data from the form for any other purpose than described below. By using the personalised download link, we will be able to determine whether you have downloaded the file and, if so, how many times you have downloaded it. If you have downloaded it, we would like to contact you about the subject via our sales department. This should preferably be done by e-mail, but if you provide a telephone number and/or postal address, we may also contact you by e-mail. If you have not completed the download, your data will be automatically deleted within 48 hours.

By downloading, you consent to our use of your data in exchange for downloading the file.

If you submit your personal data to us as part of a registration for a free product from an advertisement in a trade magazine, we will contact you on the subject via our sales department.

By entering, you agree to the use of your data in exchange for the advertised free product.

Registration for on-site training and workshops

You can find the names and contact details of the persons responsible for organising the events on our website under Service > Seminars and Online Trainings. You can send us your questions about the events offered or also your registration via the communication options e-mail/telephone call/telefax. You can also use our registration form for your registration via the "To register" button.  We process the data required for your participation (your name, your company, your e-mail address) as well as your further details in the comments field. The legal basis for the processing is "Contractual and pre-contractual purposes". We use your information exclusively for processing your booking and organising the training.

Within our company, we share your information with those involved in organising the training and billing. If you provide details of your room preference and arrival, we will pass on your name and arrival date to hotels in our vicinity.

Registration for our online seminars and events

If you register for one of our online seminars and events using the relevant form, we will process your data (surname, first name, company, email address, postcode, city, country, target group and, if applicable, your comments) in order to contact you after the training. This can be done by the organisers of the events themselves (follow-up surveys, sending recordings of the event) and by our sales department. Contact will be made without obligation by e-mail or, if you have left an option, also by telephone. Contact by our sales department may relate to the topic of the event, but also to other products and solutions of Theben AG. The legal basis for the processing of this data is your consent in accordance with Art. 6 Para. 1 lit. a DSGVO. We determine the sales representative responsible for you based on the postcode you provide.

Should it be possible to ask questions via a chat function during the online event, these will be stored exclusively in our online seminar software. The chat protocols will not be passed on. You will be informed of this at the beginning of the relevant event. Our webinars are regularly recorded. In the event of a recording, you will be informed before the start of the event.

Registration for our trade fair events

As a recipient of our newsletter, you can register, via our form, for an evening event at our stand at an industry trade fair.

By submitting the form, you agree that we may store your personal data for the aforementioned purpose. Further confirmation is not required. The storage of your data is based on "Legitimate Interest" according to Art. 6 para. 1 let. f DSGVO. We will only use your data for the planning and organisation of our evening event and will delete it after the event. With your registration, you may receive a one-day voucher for free admission to the trade fair (see following section).

Contact - Inquiry form

For questions of any kind, we offer you the possibility to contact us via a form provided on the website. In doing so, it is necessary to provide a valid e-mail address as well as your surname and first name so that we know who the enquiry is from and so that we can answer it. Further information can be provided voluntarily. Data processing for the purpose of contacting us is based on your voluntarily given consent in accordance with Art. 6 para. 1 p. 1 lit. a DSGVO. The personal data collected by us for the use of the contact form will be deleted after the request you have made has been dealt with.

Contact our customer service via WhatsApp

In addition to the contact options mentioned on the Theben website, you can also use the messenger service WhatsApp to contact our customer service.

The legal basis of our use of WhatsApp is our legitimate interest in communicating with you. On these end devices, only the data of the persons directly involved in the communication are processed. The essential content of your communication with us is manually transferred to the customer service systems. This processing of your data by the data controller Theben AG is carried out on the legal basis of "contractual or pre-contractual purposes". This processing of your data by Theben is carried out on the legal basis "Contractual or pre-contractual purposes" according to Art. 6 para. 1 b) DSGVO.

Our use of cookies

Our website uses cookies. These are small files that our web server transfers to your PC. Cookies do not cause any damage to your end device and do not contain viruses, Trojans or other malware.

A distinction is made here between technical cookies(1) , which ensure the correct functioning of our website (these cookies are set automatically) and tracking cookies(2) for marketing and analysis purposes, which require your consent.

Cookies are also differentiated according to how long they are stored. Session cookies are automatically deleted when you close your browser. Permanent cookies, on the other hand, remain stored on your PC; your browser can provide information about how long they are stored. A permanent cookie can be read again the next time you visit our website. To prevent this, you can delete the permanent cookie after visiting our website. Permanent cookies can be used, for example, to analyse your use of our website. We use session cookies to optimise the user-friendliness of our website. The data processed by cookies is necessary for the aforementioned purposes to protect our legitimate interests and those of third parties in accordance with Art. 6 (1) sentence 1 lit. f DSGVO.

Tracking tools

The tracking measures listed below and used by us are carried out on the basis of Art. 6 para. 1 lit. a DSGVO. With the tracking measures used, we want to ensure a needs-based design and the ongoing optimisation of our website. In addition, we use the tracking measures to statistically record the use of our website and to evaluate it for the purpose of optimising our offer for you. These interests are to be regarded as legitimate within the meaning of the aforementioned provision. The respective data processing purposes and data categories can be found in the corresponding tracking tools.

The IP addresses of the users are also stored. However, we use an IP masking procedure (i.e. pseudonymisation by shortening the IP address) to protect users. In general, no clear user data (such as e-mail addresses or names) is stored in the context of web analysis, A/B testing and optimisation, but pseudonyms. This means that we as well as the providers of the software used do not know the actual identity of the users, but only the information stored in their profiles for the purpose of the respective procedures.

Matomo

Matomo is software that is used for the purposes of web analysis and reach measurement. Within the scope of the use of Matomo, cookies are generated and stored on the end device of the user. The user data collected in the course of using Matomo is only processed by us and is not shared with third parties. Legal basis: Consent (Art. 6 para. 1 p. 1 lit. a. DSGVO);

Deletion of data: The cookies have a maximum storage period of 13 months.

The collected and pseudonymised data is not passed on to Matomo. Instead, they are stored on our own server at a certified hosting provider in Germany (Hetzner).

Google Analytics

On the legal basis of our legitimate interest in improving our web offering, our website uses Google Analytics, a web analytics service provided by Google Inc (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter "Google" ("Google").  Google Analytics uses "cookies", which are text files placed on your computer, to help the website analyse how users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. In the event that IP anonymisation is activated on this website, however, your IP address will be truncated beforehand by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of our website.

Browser add-on to deactivate Google Analytics

The browser add-on for deactivating Google Analytics gives the website visitor more control over which data about visited websites is collected by Google Analytics. The add-on tells the JavaScript (ga.js) of Google Analytics that no information about the website visit should be transmitted to Google Analytics. If you would like to use this feature, download and install the add-on for your current web browser. The browser add-on to disable Google Analytics is available for Internet Explorer, Google Chrome, Mozilla Firefox Apple Safari and Opera.

Google Analytics GA4

This website uses Google Analytics 4.0, a service provided by Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google"), to analyse the use of websites.

When using Google Analytics 4.0, so-called "cookies" are used as standard. Cookies are text files that are stored on your terminal device and enable an analysis of your use of a website.

In Google Analytics 4.0, the anonymisation of IP addresses is activated by default. Due to IP anonymisation, your IP address will be truncated by Google within Member States of the European Union or in other contracting states to the Agreement on the European Economic Area. According to Google, the IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

On our behalf, Google uses this and other information to evaluate your use of the website, to compile reports about your website activities and usage behaviour and to provide us with other services related to your website and internet usage.

The data collected in the context of the use of Google Analytics 4 will be retained for 2 months and then deleted.

All processing described above, in particular the setting of Google Analytics cookies for the storage and reading of information on the end device used by you for the use of the website, will only take place if you have given us your express consent for this in accordance with Art. 6 (1) lit. a DSGVO. Without your consent, Google Analytics 4 will not be used during your use of the website.

Matomo analysis tool

Web analytics (also referred to as "reach measurement") is used to evaluate the flow of visitors to our online offering and may include behaviour, interests or demographic information about visitors, such as age or gender, as pseudonymous values. With the help of the reach analysis, we can, for example, recognise at what time our online offer or its functions or content are most frequently used or invite re-use. Likewise, we can understand which areas need optimisation.

In addition to web analysis, we may also use testing procedures, e.g. to test and optimise different versions of our online offer or its components.

Unless otherwise stated below, profiles, i.e. data summarised for a usage process, can be created for these purposes and information can be stored in a browser or in a terminal device and read from it. The information collected includes, in particular, websites visited and elements used there as well as technical information such as the browser used, the computer system used and information on usage times. If users have agreed to the collection of their location data from us or from the providers of the services we use, location data may also be processed.

Google Double Click

The tool allows us to track the frequency of your page views or traffic to our website in general. This allows us to track how often, how long and which parts of our website you have used.

Passing on data

Your personal data will not be transferred to third parties for purposes other than those listed below. We will only disclose your personal data to third parties if:

  • you have given your express consent to this in accordance with Art. 6 para. 1 p. 1 lit. a DSGVO,
  • the disclosure is necessary in accordance with Art. 6 (1) p. 1 lit. f DSGVO for the assertion, exercise or defence of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data,
  • in the event that there is a legal obligation for the disclosure pursuant to Art. 6 para. 1 sentence 1 lit. c DSGVO, as well as
  • this is legally permissible and necessary according to Art. 6 para. 1 p. 1 lit. b DSGVO for the processing of contractual relationships with you.

Social media presences

We maintain fan pages within various social media platforms with the aim of communicating with users, customers and interested parties and informing them about our services there. Within the scope of these online presences, the social media providers and we process your personal data.

It is possible to create profiles, company pages or groups on the various information services. Users can upload contributions, photos and videos on their own profiles and on our fan pages, or share and comment on this content. Users can also get in touch with each other by writing public or private messages.

We would like to point out that you use the information services offered on your own responsibility and that we are not aware of all details of the data processing of the social media providers from the USA at the present time. This applies in particular to the use of interactive functions (e.g. commenting, sharing, rating).

It is possible to reduce the processing of your personal data when using our fan pages by logging out of the corresponding social media platform or deactivating the "stay logged in" function, deleting the cookies present on your end device and closing and restarting your browser. In this way, information by which you can be directly identified is deleted. This allows you to make limited use of our fan pages without revealing your user ID.

Contact via private or public messages

On our fan pages, you can send us private or public messages (comments). If you contact us via private messages, we store the data you provide in order to be able to process your enquiries. We then delete your data 6 months after the last message. This does not apply if legal provisions prevent deletion or if further storage is necessary for the purpose of providing evidence or if you have consented to longer storage.

If, on the other hand, you send us a public message, the data you provide will also be visible to all other users. Public messages can only be deleted by the user himself.

The processing of your data is necessary for the aforementioned purposes to protect our legitimate interests pursuant to Art. 6 (1) f) DSGVO.

Facebook

Theben uses the technical platform and services of Meta Platforms Ireland Ltd. 4 Grand Canal Square Grand Canal Harbour Dublin 2 Ireland ("Facebook") for the information service offered here.

Collection and storage of personal data as well as type and purpose of their use

The data collected about you when using the Service will be processed by Meta Platforms Irelands and may be transferred outside the European Union. This includes, but is not limited to, your IP address, the application you are using, details of the terminal device you are using (including device ID and application ID), information about websites you have visited, your location and your mobile phone provider.

This information is used to provide us, as the operator of the Facebook page, with statistical information about the use of the Facebook page.

This information is used to provide us, as the operator of the Instagram page, with statistical information about the use of the Instagram page.

Collection and storage of personal data as well as type and purpose of their use

The data collected about you when using the service is processed by Twitter Inc. and may be transferred to countries outside the European Union. This data includes your IP address, the application you are using, information about the terminal device you are using (including device ID and application ID), information about websites you have visited, your location and your mobile phone provider.

This data is assigned to the data of your Twitter account or your Twitter profile. We have no influence on the type and scope of the data processed by Twitter, the type of processing and use or the transfer of this data to third parties. Search Analysis Tool Luigi's Box

On our website, we use the tool Luigi's Box (https://www.luigisbox.com/) with which we can evaluate and optimise the search behaviour of website visitors. No personal data is collected in this process. The sole purpose of the cookie is to link individual events to a session and to link these sessions to each other in order to determine the number of relevant profiles of a search analysis. It is not possible to draw conclusions about you as a person via the cookie set. The data collected is stored exclusively in a data centre in Frankfurt. The search analysis includes a machine learning procedure to determine the best listing of search results.
